Client Intake Acknowledgement
I acknowledge and understand the following:
THIS AGREEMENT (“Agreement ”) is made by the undersigned adult (the “Participant”), and The Reformery, a New York corporation, , its subsidiaries, and affiliates, and all of its respective members, employees, heirs, successors, agents, contractors, and assigns, and, its employees and agents (also collectively the “Parties”).
Participant is entering into this Release after having viewed or having the opportunity to view the studio and/or place of instruction; having reviewed the instructor’s qualifications; having had the scope of the services and associated risks explained; and having had an opportunity to ask questions regarding the services and risks associated with this exercise program. Any questions Participant has asked have been answered to the Participant’s complete satisfaction.
USING THIS STUDIO OWNED BY THE REFORMERY, AND/OR TAKING INSTRUCTION VIRTUALLY OR VIA ANY ELECTRONIC MEANS INVOLVES THE RISK OF INJURY TO YOU OR YOUR GUEST(S), WHETHER YOU OR SOMEONE ELSE CAUSES IT. SPECIFIC RISKS VARY FROM ONE ACTIVITY TO ANOTHER AND THE RISKS RANGE FROM MINOR INJURIES TO MAJOR INJURIES, SUCH AS CATASTROPHIC INJURIES INCLUDING DEATH. SUBJECT TO THOSE LIMITATIONS DISCUSSED IN GBL § 623(3) AND NEW YORK GENERAL OBLIGATIONS LAW § 5-326, IN CONSIDERATION OF YOUR PARTICIPATION IN THE ACTIVITIES OFFERED BY THE REFORMERY, YOU UNDERSTAND AND VOLUNTARILY ACCEPT THIS RISK. FURTHER, YOU UNDERSTAND AND ACKNOWLEDGE THAT THE RELEASEES DO NOT MANUFACTURE FITNESS OR OTHER EQUIPMENT, BUT PURCHASE AND/OR LEASE EQUIPMENT. YOU UNDERSTAND AND ACKNOWLEDGE THAT THE REFORMERY IS PROVIDING INSTRUCTIONAL SERVICES AND MAY NOT BE HELD LIABLE FOR DEFECTIVE PRODUCTS. YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THE FOREGOING AND KNOW OF THE NATURE OF THE ACTIVITIES.
Participant is voluntarily participating in the activity with full knowledge, understanding, and appreciation of the risks inherent in any physical exercise and expressly assumes all risks of injury and even death which could occur by reason of participant’s participation. Risks may include physical injury due to exertion, the risk of tripping, muscle or body strain or sprain, as well as injury from use of equipment such as steps, balls. weights and/or bands. Further, I may experience transient dizziness, lightheadedness, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the activity, I will discontinue my participation immediately and seek appropriate medical attention.
Participant acknowledges that The Reformery cannot guarantee against the risk of transmission of any virus, germs or disease. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.
I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19.
I hereby knowingly assume the risk of injury, harm and loss associated with the activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of The Reformery.
Participant hereby assumes full responsibility for risks of bodily injury, property damage, or death to a Participant due to participation in any program or exercise.
Participant agrees that The Reformery is not responsible for defective equipment or goods provided or sold by The Reformery. To the extent that damages are permitted under the law, any such damages are limited to the value or costs of the products or goods sold.
Participant expressly agrees that the terms of the Agreement are intended to be as broad and inclusive as is permitted by the laws of New York. Any provision of this Agreement found to be invalid by the court having jurisdiction shall be invalid only with respect to such provision or portion and the remainder shall be enforced to the greatest extent possible.
PARTICIPANT CERTIFIES THAT HE/SHE IS AT LEAST 18 YEARS OF AGE, OR IF HE/SHE IS UNDER 18 YEARS OF AGE, THE PARTICIPANT’S PARENT OR LEGAL GUARDIAN CERTIFIES, THAT HE/SHE HAS READ AND VOLUNTARILY SIGNS THIS AGREEMENT AND THE PARTICIPANT IS OF GOOD HEALTH AND CAPABILITY TO PARTICIPATE.
Reservations/Charges
You should be aware that classes and series expire, and future prices are subject to change. We accept American Express, MasterCard, Visa and Discover. Cash payments may only be made in the The Reformery studio. You can reserve classes online but not later than 1 hour prior to class time. Deadlines apply regardless of available functionality.
Your credit/debit card will be charged for your order when you submit your reservation. The Reformery will not process reservation charges that use an incorrect, expired, or over-the-limit credit card. We will make our best efforts to contact you if this occurs. If you fail to pay any fees or charges when due, services or privileges may be suspended or terminated. You shall be responsible and liable for any fees, including attorneys’ fees and collection costs, that The Reformery may incur in its efforts to collect any unpaid balances from you.
Cancellation Policy
Group Classes
Life can be unpredictable, we understand that things happen and plans change.
Out of fairness to all of our clients, The Reformery has a strict 12 hour cancellation policy for all classes. Please cancel through our website or app.
We do not accept cancellations via email, phone or social media.
If you miss your class and don’t abide by the cancellation policy, the following applies;
Packs/single class/limited membership: Forfeit 1 x class on package or membership.
Unlimited members: $15 late cancellation fee applies for bookings cancelled less than 12 hours in advance or no shows.
Winter Weather Studio Closure/Class Cancelation:
We will close the studio based on city school closings and/or as needed due to weather.
Clients will be notified via email, text and instagram.
If we don't cancel classes then our late cancelation policy is in affect (12 hours). You can review full policy here:
Surprise Snow 2 Hour Grace Period:
If we don't cancel classes, you can email us (hello@thereformerynewyork.com) at least two hours before the start of class stating that you can't make your reservation due to weather concerns, we will waive the late cancel fees or loss of credit.
We can only honor this request via email, NOT IG or phone.
Private Pilates
The Reformery has a strict 24 hour cancellation policy for all Private sessions.
Please cancel through our website or app at least 24 hours prior to your appointment or the following applies:
Private Pilates: Charged for 1 x private session
We do not accept cancellations via email, phone or social media.
No exceptions. No refunds. No credits.
Injury
The Reformery instructors are movement professionals, however, not all instructors at The Reformery are medically trained. For your safety, you are required to let your instructor know about any injuries or ailments that may affect your Pilates experience.
All instructors reserve the right to restrict clients to a particular class type for safety reasons.
Pregnancy
Every woman's experience of pregnancy and birth is different. We aim to accommodate all women, allowing them to keep moving during and after pregnancy.
Prenatal women must inform instructors of their pregnancy and have clearance from their medical professional to return to Pilates.
We encourage all Prenatal clients to take our pre/postnatal class or book a Private Pilates 1:1 before joining classes.
Postnatal clients must have clearance from their medical professional to return to Pilates.
We encourage all Postnatal clients to take our pre/postnatal class or book a Private Pilates 1:1 before rejoining classes. This is important to assess any changes that may have occurred throughout later stages of pregnancy and birth.
Late Arrival
Please arrive 10 minutes early to enjoy the complete Reformery experience.
If you anticipate being late, please email hello@thereformerynewyork.com.
Out of respect for our clients, instructors, and your safety, there is no admittance after 10 minutes of the scheduled class time. After 10 minutes your class credit and spot is forfeited. For unlimited members, there will be a $15 late cancel fee.
Waitlist
Our system will automatically add you to class if a spot becomes available up until 12 hours before the scheduled class time.
You will receive an email confirmation when you have been added to class from the waitlist.
If you are on the waitlist, and know you won’t be able to make it to class. Please remove yourself from the waitlist online or on the app.
Your spot in class can be given away at the commencement of class if there is someone on standby waiting at the studio.
If you have been added to class from the waitlist, standard cancellation policies apply.
Socks
For safety and sanitation purposes grippy socks are required for all reformer classes. Grippy socks are available for purchase.
Return + Refund Policy
All sales are final.
Refunds will be issued in case of a merchant processing software error, or if The Reformery incorrectly processes a sale on the client's behalf.
All return requests must be submitted in writing to hello@thereformerynewyork.com within 7 days of the sale date.
Lost Property
Although we do our best to look after your belongings, The Reformery is not responsible for personal lost or stolen items.
Pets
Pets are not permitted in any Reformery studio with the exception of service animals that have presented paperwork to management or staff of The Reformery.
Children
Children under the age of 18 can take class with written or verbal permission, provided by a parent or guardian. Acceptance of the Terms + Conditions is a form of written permission.
No Discrimination
Our priority is creating a safe and welcoming community. The Reformery prohibits discrimination or harassment based on race, color, religion, creed, sex, national origin, age, disability, marital status, veteran status or any other status protected by applicable law. Each individual in our community has the right to attend class within a space that is inclusive and free from discrimination.
No Harassment
The Reformery has zero tolerance for harassment on the basis of race, color, religion, creed, sex, national origin, age, disability, marital status, veteran status or any other status protected by applicable law. Violations of this policy will addressed appropriately by management.
Harassment is generally defined as unwelcome verbal or non-verbal conduct, based upon a person’s protected characteristic, that denigrates or shows hostility or aversion toward the person because of the characteristic, and which affects the person’s learning opportunities or benefits, has the purpose or effect of unreasonably interfering with the person’s work performance, or has the purpose or effect of creating an intimidating, hostile or offensive environment. Harassing conduct includes, but is not limited to: epithets; slurs or negative stereotyping; threatening, intimidating or hostile acts; denigrating jokes and display or circulation in the workplace of written or graphic material that denigrates or shows hostility or aversion toward an individual or group based on their protected characteristics.
Sexual harassment is defined as unwelcome sexual advances, requests for sexual favors and other verbal, visual or physical conduct of a sexual nature, when:
submission to such conduct is made either explicitly or implicitly;
submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or
such conduct has the purpose or effect of unreasonably interfering with an individual or creating an intimidating, hostile or offensive environment.
Examples of sexual harassment include: unwelcome or unsolicited sexual advances; displaying sexually suggestive material; unwelcome sexual flirtations, advances or propositions; suggestive comments; verbal abuse of a sexual nature; sexually oriented jokes; crude or vulgar language or gestures; graphic or verbal commentaries about an individual’s body; display or distribution of obscene materials; physical contact such as patting, pinching or brushing against someone’s body; or physical assault of a sexual nature.
Harassment and Discrimination Complaint Procedure
Anyone who feels that he or she has been harassed or discriminated against, or has witnessed or become aware of discrimination or harassment in violation of these policies, should bring the matter to the immediate attention of The Reformery management - hello@thereformerynewyork.com
No person will be retaliated against for making a complaint in good faith regarding a violation of these policies, or for participating in good faith in an investigation pursuant to these policies.
The Reformery will promptly investigate all allegations of discrimination and harassment, and take appropriate action, based on the outcome of the investigation. Such action may include counseling, disciplinary warning, demotion, or termination of employment.
Waiver and Release
By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the “Classes and Facilities”) of The Reformery Inc. and its subsidiaries, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in all forms of exercise. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You also acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by staff. If in the subjective opinion of the The Reformery staff, you would be at physical risk participating in The Reformery Classes, you understand and agree that you may be denied access to the Classes and Facilities until you furnish The Reformery with an opinion letter from your medical doctor, at your sole cost and expense. In consideration of being allowed to participate in and access the Classes and Facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes and Facilities, (2) release, indemnify, and hold harmless The Reformery, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of The Reformery’s Classes and Facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using The Reformery’s Classes and Facilities, and should not be participating in any Classes.

The Reformery has not reviewed all the sites linked to the Website and/or App, and is not responsible for the content or any off-site pages or other linked sites. Although a third party website and/or app may contain the The Reformery logo, please understand that it is independent from The Reformery, and that The Reformery has no control over the content of that website and/or app.
Going to third party or off-site websites from the Website and/or App is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with The Reformery
Photo/Video Policy
By participating in any class or event at The Reformery, you agree and consent to the use of photographs, videos, and other recordings taken during the session by The Reformery staff or other approved content creator or contractor. These may include images or footage of clients and their likeness, which may be used for promotional, marketing, and advertising purposes across our website, social media, and other marketing channels without financial or other compensation. We respect your privacy, and if you prefer not to be photographed or filmed, please inform the instructor or staff prior to the start of class, and we will make every effort to accommodate your request.
At The Reformery, we support clients who want to self-record or photograph while in class or at the studio. To protect the privacy and focus of other class participants, we enforce the following recording policy:
1. Permission and Purpose:
Recording any portion of a class session is only permitted with explicit prior consent from the instructor and all individuals who may appear in the recording. Recording should solely serve as content creation for sharing on personal platforms and not for personal practice outside of The Reformery
2. Privacy and Respect:
Clients who wish to record a class session must ensure that no other clients are in the frame of the recording without their explicit consent.
Any recording activity should not disrupt the flow or focus of the class for other participants. This includes avoiding any noise or behavior that may distract or disturb others.
3. Discretion and Sensitivity:
Recording should be conducted discreetly and with sensitivity to the privacy and comfort of all individuals present in the studio.
Clients are advised to position their recording devices in a manner that minimizes the visibility and intrusion into the personal space of others.
4. Instructor Discretion:
Instructors reserve the right to prohibit recording during certain segments of the class or for specific exercises if they deem it necessary to preserve the integrity of the session or the comfort of participants.
Instructors may also intervene if they observe any recording activity that is causing disruption or discomfort to other clients.
5. Enforcement and Consequences:
Clients found to be violating this recording policy may be asked to cease recording immediately and may face further disciplinary action, including potential suspension or termination of studio privileges.
Repeat offenses or egregious violations of this policy will be addressed with increasing severity, up to and including permanent expulsion from the studio.
By participating in classes at The Reformery, clients acknowledge their understanding and acceptance of this recording policy. We appreciate your cooperation in maintaining a positive and respectful studio environment for all. If you have any questions or concerns regarding this policy, please don't hesitate to contact us.
Phone Usage Policy
At The Reformery, we are committed to providing a serene and focused environment for all our clients to achieve their fitness goals. In order to maintain this atmosphere and ensure the safety and concentration of all participants during classes, we have implemented the following policy regarding phone usage:
1. Phone Presence: Clients are permitted to have their phones with them during classes, but we kindly ask that all devices be set to silent mode or vibrate to minimize disruptions.
2. Texting and Calls: While we understand the importance of staying connected, we request that clients refrain from texting, making phone calls, or engaging in any other form of phone-related activity during class sessions.
3. Designated Phone Areas: If a client needs to respond to a text message or take a phone call, we ask that they step out of the exercise area and into the lobby or lounge area to minimize disruption to the class.
By adhering to these guidelines, we aim to create a positive and focused atmosphere where all clients can fully benefit from their Pilates experience. We appreciate your cooperation in maintaining this standard
